There's been some discussion here on Free Speech. Westonka Schools can be said to have its free speech limited in the area of politics. I'd say the primary reason for that is they are funded with our money. Even then, groups such as Yes! Westonka can take up a cause that is similar to a district's perceived cause. There is also the "rebuke" option where a district apparently can send out a mailing to rebut what might be said to be inaccurate claims. The rebuke option seems subjective. If one minor opinion appears in a local paper, is that enough cause for district wide mailing?

Some have said free speech is an individual right we are born with as opposed to one "granted" to us by our government. My point with the Hill/Notch situation is that the Notchs may have been required to argue that they have a free speech right before Judge Lipman. When two people or a small group have to consider possible legal consequences to voicing their opinion, this is when free speech is hurt.

Earlier I wrote about groups being credibile or not. I am sorry, but we don't need judges to place a value on the District's, or Yes! Westonka's or the Notch's information.  We are able to do that ourselves.

      My moral compass lead the action when I saw a "Senior Alert" Flyer telling our seniors' that their taxes would go up 47%. They won't, but how would an elderly widow afraid she would lose her home know that?

      The district was advised by their attorney not to put a rebuttal flyer out addressing this and other misleading information in the flyer. It's like being in a boxing match with your hands tied behind your back.

        It's true Lipman did not place a value on Wake Up's opinions, she found them to be opinions and outside her domain.
